Image Protection in the UK

"Abstract: Because there is no codified “image rights” law in the UK, the protection of a person’s image is achieved via a combination of the laws of privacy, data protection and passing off. This article highlights the way in which these options have been utilised in the UK and sets out some practical tips for avoiding issues. It includes a detailed explanation of the key case in this area which involved the sale of a T-shirt bearing Rihanna’s image. The UK does not protect “image rights” as such but it has adapted to protect a person’s image via various different routes including privacy law, data protection and the law of passing off (which is similar to unfair competition). This article provides an overview of these different options."
